In its summary, the court concluded that the group’s proscription was "disproportionate" because "the nature and scale of its activities falling within the definition of terrorism had not yet reached the level, scale and persistence to warrant proscription." Despite this ruling, Palestine Action will remain banned temporarily to allow for additional legal proceedings.
The Home Secretary, Shabana Mahmood, announced that the government intends to appeal the High Court’s decision, maintaining that the group’s proscription "followed a rigorous and evidence-based decision-making process," and received parliamentary approval. "I am disappointed by the Court’s decision and disagree with the notion that banning this terrorist organisation is disproportionate," she wrote on social media.
Palestine Action was initially banned in July 2025 under the Terrorism Act after its members entered a Royal Air Force base and spray-painted two aircraft, causing £7 million ($9.44 million) in damage, according to official reports. Since then, hundreds of pro-Palestine activists have been arrested throughout the UK.
